Maurico DaSilva, 30, of Painesville, has been charged with aggravated vehicular homicide in the death of Timothy Roos, 35, of Mentor.
In addition to the second-degree felony, DaSilva was also charged with vehicular homicide, a fourth-degree felony, vehicular manslaughter, a first-degree misdemeanor, and speeding, a minor misdemeanor, according to the four-count indictment filed Thursday.
On Dec. 1, Roos was headed southbound around 8:57 a.m. on state Route 44 on his way to Heinen’s in Chardon, where he worked, when DaSilva, heading northbound, hit Roos head on while trying to pass another vehicle, according to the Ohio State Highway Patrol.
The crash happened a half mile south of Hosford Road.
DaSilva, who is married and has a 5-year-old child, told Chardon Municipal Court Judge Terri Stupica during his initial court appearance that he was working the third shift at Pentair Water in Chardon and was headed home at the time of the crash.
